释义	法律分析：退休人员被判刑后，服刑期间不能领取养老金，刑满释放后养老金仍按服刑前的标准发放。被判徒刑缓刑期间，可以继续享受基本养老保险待遇，但基本养老金不作调整。法律依据：《关于贯彻执行国务院关于工人退休、退职的暂行办法的若干具体问题的处理意见》第十八条退休、退职工人因为违犯法纪被判处徒刑的时候,在服刑期间应该停止享受各项退休、退职待遇,并且收回其退休、退职证件。服刑期满恢复政治权利后的生活待遇,由原发给退休费和退职生活费的单位酌情处理。
