释义	法律分析：包二奶不以夫妻名义共同生活，不是重婚罪。构成重婚罪的犯罪主体有两类人，一是有配偶的人，在夫妻关系存续期间又与他人成立婚姻关系；二是没有配偶的人，明知对方有配偶而与之结婚。行为人构成重婚罪的，处二年以下有期徒刑法律依据：《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
