释义	孩子不是自己的可以争取抚养权。法律规定只有孩子的亲生父母才拥有抚养权。但是如果一方在抚养孩子多年以后才发现孩子非亲生,但是在多年的抚养中已经形成了抚养关系，那么就可以争取孩子的抚养权。或者孩子的亲生父母放弃孩子的抚养权，并且孩子愿意和养父母生活。八周岁以上的孩子法院会听取孩子的想法和意见。【法律依据】《民法典》第一千零七十二条，继父母与继子女间，不得虐待或者歧视。继父或者继母和受其抚养教育的继子女间的权利义务关系，适用本法关于父母子女关系的规定。
