员工辞职不批怎么办

法律分析:
员工辞职公司不批,员工离职无需征得用人单位的同意。法律规定,劳动者提前30日书面形式通知单位,可以解除合同。如果是在试用期的,可以提前三日通知用人单位解除;如果用人单位未及时缴纳社保、支付劳动报酬、提供劳动保护或者劳动条件的,劳动者可以解除劳动合同,用人单位应当支付经济补偿金。
法律依据:
《中华人民共和国劳动合同法》第三十七条 劳动者提前三十日以书面形式通知用人单位,可以解除劳动合同。劳动者在试用期内提前三日通知用人单位,可以解除劳动合同。
