释义	信用卡诈骗罪的认定如下： 1、该罪侵犯的客体是信用卡管理制度和公私财产所有权； 2、该罪客观方面表现为行为人采用虚构事实或者隐瞒真相的方法，利用信用卡骗取公私财物的行为； 3、该罪的主体是一般主体，自然人可成为本罪的犯罪主体； 4、该罪的主观方面是故意。而且是直接故意，行为人主观上还必须具有非法占有公私财物的目的。间接故意和过失犯罪不能构成本罪。在此应指出的是，在信用卡诈骗罪的各种行为中，行为人因行为不同，其犯罪故意也各有其特定内容而不尽相同。
