释义
应当将未经审批机构批准的股权转让协议视为已成立、未生效的行为。 【法律依据】 依照《合同法》第44条第2款的规定，法律、行政法规规定应当办理批准手续，或者办理批准、登记等手续才生效，在一审法庭辩论终结前当事人仍未办理批准手续的，或者仍未办理批准、登记等手续的，人民法院应当认定该合同未生效。
