释义	法律分析：(一)行为人具有相应的民事行为能力。(二)意思表示真实。(三)不违反法律、行政法规的强制性规定，不违背公序良俗。(四)继承人放弃继承的，应当在遗产处理前，作出放弃继承的表示。没有表示的，视为接受继承。法律依据：《中华人民共和国民法典》第一千一百二十四条继承开始后，继承人放弃继承的，应当在遗产处理前，以书面形式作出放弃继承的表示有表示的，视为接受继承。受遗赠人应当在知道受遗赠后六十日内，作出接受或者放弃受遗赠的表示期没有表示的，视为放弃受遗赠。
