释义	法律分析：一般而言，磅差不超过当事人约定的范围（比如±3‰）的，按其中一方的过磅数量为准计价，双方互不究责；超过约定磅差范围的，另一方可以要求第三方公磅过磅并以公磅数量为准计价，公磅费用由与公磅磅差较大的一方（失误方）承担。磅差条款一般适用于称重计量的产品买卖合同，如煤炭、大米及其他大批量交易。法律依据：《广东省商品交易市场管理条例》第五条市场商品交易活动应当遵循自愿、平等、公平、诚实信用的原则，遵守商业道德。市场管理应当遵循公开、公平、公正的原则。
