反担保合同是什么意思 |

反担保合同是指为债务人担保的第三人，为了保证其追偿权的实现，而与债务人以及反担保保证人签订的担保合同。如银行对借款人发放保证贷款时，保证人因要承担风险，故要求借款人为自己再提供担保，借款人为保证人所提供的担保即属反担保。签订的合同即为反担保合同。
最高额保证合同和保证合同的区别
1、依据《中华人民共和国民法典》规定，最高额保证担保的债务仅限于一定期间发生的借款合同和某项商品交易合同；而《中华人民共和国民法典》规定“本法所称保证，是指保证人和债权人约定，当债务人不履行债务时，保证人按照约定履行债务或者承担责任的行为”，未限定范围，因此普通保证广泛适用于各种可以货币计量的债务、交易、承诺。
2、最高额保证是对将来发生的不确定债务担保，设定的担保对象一般是将来发生的债务，这些债务将来是否发生是不确定的，债务额是多少也不确定。
3、最高额保证对一定期内连续发生的债务作担保，所担保的债务必须具有连续性，不能对不具有连续性的债务设定最高额保证。普通保证担保的债务是一项保证对应一笔特定债务，不具有连续性。
4、最高额保证是限额担保，债权人只能在最高限额内要求保证人承担保证责任，即不论将来实际发生时如何变动，均以最高限额为限，达不到最高限额的，以实际发生的债务余额为限；超过最高限额的，以最高限额为限。

设立担保物权，应当依照本法和其他法律的规定订立担保合同。担保合同包括抵押合同、质押合同和其他具有担保功能的合同。担保合同是主债权债务合同的从合同。主债权债务合同无效的，担保合同无效，但是法律另有规定的除外。
担保合同被确认无效后，债务人、担保人、债权人有过错的，应当根据其过错各自承担相应的民事责任。
