法律分析：我国法律法规对于职工就餐时间属于法定工作时间并无明确规定的情况下，如果双方通过规章制度、劳动合同等明确约定职工用餐时间不属于工作时间，原则上法院会尊重用人单位与劳动者双方的约定，认定职工职工就餐时间不属于法定工作时间。对于双方没有任何约定或规定的，则会考虑劳动者实际用餐需要以及其工作性质、工作强度等加以认定。
法律依据：《劳动法》第三十六条规定：国家实行劳动者每日工作时间不超过八小时、平均每周工作时间不超过四十四小时的工时制度。
