不定时工作制是指因生产特点、工作特殊需要或职责范围，无法按标准工作时间衡量、需机动作业而采取不确定工作时间的一种工时制度。国家实行劳动者每日工作时间不超过8小时、平均每周工作时间不超过44小时的工时制度。用人单位应当保证劳动者每周至少休息1日。
