法律分析：雇佣关系是指雇员在一定或不特定的期间内，接受雇主的指挥与安排，向雇主提供劳务，雇主向雇员支付报酬的权利义务关系。员工在公司里上班是劳动关系，劳务关系是指劳动者与用工者根据约定，由劳动者向用工者提供一次性的或者是特定的劳动服务，用工者依约向劳动者支付劳务报酬的法律关系。
法律依据：《中华人民共和国劳动合同法》 第七条 用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。
