长期待岗被辞退怎么处理

法律主观：
待岗并不是代表着要被辞退。除非是劳动者不能胜任工作，符合《劳动合同法》规定的被辞退的情形，用人单位提前三十日以书面形式通知劳动者本人或者额外支付劳动者一个月工资后，才可以合法非过失性辞退劳动者，或者依法过失性辞退劳动者。
