外国人在中国能否当法人

法律分析：我国法律对法定代表人无国籍要求，因此外国人完全可以担任公司法定代表人。但需要该外国人到其国家所在的中国大使馆开具身份证明和提供本人护照。外国人在中国担任法定代表人的不能参与公司股权出资。
法律依据：《中华人民共和国公司法》第十三条 公司法定代表人依照公司章程的规定，由董事长、执行董事或者经理担任，并依法登记。公司法定代表人变更，应当办理变更登记。
