释义	法律分析: 集体用地房屋一般不能租。集体用地上的房屋系农村集体经济组织所有，未经土地管理部门准许擅自改变集体土地使用用途对外出租进行商业经营活动违反国家法律、行政法规的强制性规定，应当认定为无效。法律依据:《《中华人民共和国土地管理法》》第八十二条擅自将农民集体所有的土地通过出让、转让使用权或者出租等方式用于非农业建设，或者违反本法规定，将集体经营性建设用地通过出让、出租等方式交由单位或者个人使用的，由县级以上人民政府自然资源主管部门责令限期改正，没收违法所得，并处罚款。
