中国公共场合吸烟违法吗？
释义
法律分析：
1、在全国范围内，室外公共场所吸烟不违法；2、在全国范围内，室内公共场所吸烟违法，但是无处罚或者处理措施；3、个别省市制定了地方性法规，则依据该法规处理。比如陕西省西安市在2018年10月颁布了西安市控制吸烟管理办法，规定对违反规定的吸烟行为可以进行一定的罚款措施。目前全国性的法律法规，室外公共场所吸烟，并没有相关规定。
法律依据：
《公共场所卫生管理条例实施细则》 第十八条 明文规定：室内公共场所禁止吸烟。但是并没有处罚条款或者其他强制措施。
