离职后公司为什么要收回劳动合同
释义
法律分析：劳动者拥有的劳动合同属于劳动者本人，单位不需要也不得收回，不管劳动者是在职还是离职。用人单位在劳动者离职时应当开具离职证明，离职证明具有证明解除或者终止劳动合同的法律效力，不需要专门签订解除劳动合同协议，但是签订协议也可以。
法律依据：《中华人民共和国劳动合同法》 第八十一条 用人单位提供的劳动合同文本未载明本法规定的劳动合同必备条款或者用人单位未将劳动合同文本交付劳动者的，由劳动行政部门责令改正；给劳动者造成损害的，应当承担赔偿责任。
