释义	遗产被分割后继承人需要偿还债务，但偿还有一定顺序。应当先由按法定继承分割的遗产进行清偿，按法定继承分割的遗产不够清偿债务的，再由遗嘱继承人按所得财产的比例偿付剩余债务。但是，仍然需要保留缺乏劳动能力而又没有生活来源的法定继承人的必要份额，即未成年人和无民事行为能力人、残疾人等人必要的生活费和其他费用。法律依据：《中华人民共和国民法典》第一千一百五十九条分割遗产，应当清偿被继承人依法应当缴纳的税款和债务；但是，应当为缺乏劳动能力又没有生活来源的继承人保留必要的遗产。
