释义	拾到东西后要求失主给予10％报酬，可通过双方协商决定，如果索要的数额过高或使用了威胁手段，就属于违法行为。拾到东西应当还给失主，否则是侵占，数额较大不退还可构成侵占罪。但拾到东西的人可以请求失主补偿自己保管、交还所产生的合理费用，但绝对不可以要求额外的10％的报酬。当然，如果失主出于感谢而给的没有问题，但不能以给付报酬为筹码要挟失主，否则数额较大的话可构成敲诈勒索罪。法律依据：《民法典》第三百十七条权利人领取遗失物时，应当向拾得人或者有关部门支付保管遗失物等支出的必要费用。
