释义	法律分析：银行卡应当由本人使用，出租或者是出借银行卡本身就是违法行为。在持卡人本人明知实际持卡人会利用银行卡实施犯罪活动的情况下仍然出借自己银行卡的，出借人很可能会构成相应的共同犯罪或者是掩饰、隐瞒犯罪所得犯罪。法律依据：《银行卡业务管理办法》第二十八条个人申领银行卡，应当向发卡银行提供公安部门规定的本人有效身份证件，经发卡银行审查合格后，为其开立记名账户，银行卡及其账户只限经发卡银行批准的持卡人本人使用，不得出租和转借。
