法律分析：培训班不退费应该向消费者协会投诉。学员有选择放弃学习的权利，培训机构在合同中规定不能退费是“格式条款”、“霸王条款”，培训机构和学员之间可以有约定，但约定不能违背相关法律法规。学员或家长提供缴费依据和书面材料，他们可以协调退费事宜。所谓消费者投诉，是指消费者为生活消费需要购买、使用商品或者接受服务，与经营者发生消费权益争议 ，从而提出的书面或者口头上的异议、抗议、索赔和要求解决问题等行为。诈骗公私财物，数额较大的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金。数额巨大或者有其他严重情节的，处三年以上十年以下有期徒刑，并处罚金。数额特别巨大或者有其他特别严重情节的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。
法律依据：《中华人民共和国消费者权益保护法》 第十六条 经营者向消费者提供商品或者服务，应当依照本法和其他有关法律、法规的规定履行义务。经营者和消费者有约定的，应当按照约定履行义务，但双方的约定不得违背法律、法规的规定。经营者向消费者提供商品或者服务，应当恪守社会公德，诚信经营，保障消费者的合法权益；不得设定不公平、不合理的交易条件，不得强制交易。
