法律分析：兼职交押金本身就是违法的。人民法院在审理有关劳动争议时，也表明如果劳动者和用人单位解除或种植劳动关系后，用人单位应当返还劳动者缴纳的合同定金、抵押金、抵押物等，如果用人单位没有返还，劳动者可以依法起诉。
法律依据：《中华人民共和国劳动合同法》 第九条 用人单位招用劳动者，不得扣押劳动者的居民身份证和其他证件，不得要求劳动者提供担保或者以其他名义向劳动者收取财物。
