释义	所谓宣告死亡，是指公民下落不明超过法定期限，人民法院根据利害关系人的申请，依法宣告该公民死亡的一种法律制度，在法律上，自然人的死亡有两种：一种是自然死亡，是指在生理上的明确无误的真死。一种是法律上的推定死亡，事实上也可能死亡，也可能没有死亡。法律依据: 《中华人民共和国民法典》第十五条自然人的出生时间和死亡时间，以出生证明、死亡证明记载的时间为准;没有出生证明、死亡证明的，以户籍登记或者其他有效身份登记记载的时间为准。有其他证据足以推翻以上记载时间的，以该证据证明的时间为准。
