释义	借款抵押合同，抵押人和抵押权人是必须签订书面合同，并且明确被担保债务的种类、数额、债务人的履行期、抵押物的名称、数量、质量、状况、所在地、所有权归属或者使用权归属以及担保范围。抵押合同属于要式合同，如果是普通物的抵押，那么抵押合同签订之后即生效;但有几类物的抵押，除了签订抵押合同之外，还必须到有关部门进行登记之后，抵押权才生效。法律依据：《民法典》第172条规定：担保合同是主合同的从合同，主合同无效，担保合同无效，但法律另有规定的除外。
