释义	经营者不得采用财物或者其他手段进行贿赂以销售或者购买商品。在帐外暗中给予对方单位或者个人回扣的，以行贿论处；对方单位或者个人在帐外暗中收受回扣的，以受贿论处。根据最高人民检察院、公安部《关于经济犯罪案件追诉标准的规定》，商业贿赂的收受方如果将收受的贿赂款归个人所有，数额达到5000元以上的应予追诉。达到此标准的案件中涉及国家工作人员的案件由人民检察院主管，不涉及国家工作人员的由公安机关主管。
