释义	法律分析：承运人是指本人或者委托他人以本人名义与托运人订立海上货物运输合同的人;托运人是指将货物托付承运人按照合同约定的时间运送到指定地点，向承运人支付相应报酬的一方当事人。承运人与托运人的区别在于:承运人就是实际运送货物的人,托运人是委托承运人运送货物的人。法律依据：《中华人民共和国民法典》第四百六十五条依法成立的合同，受法律保护。依法成立的合同，仅对当事人具有法律约束力，但是法律另有规定的除外。
