法律分析:
我国《刑法》并没有关于传播艾滋病这一罪名的相关规定，但是明知自己有艾滋病而卖淫，会被依法判处处五年以下有期徒刑、拘役或者管制，并处罚金。
法律依据:
《中华人民共和国刑法》
第三百五十九条 引诱、容留、介绍他人卖淫的，处五年以下有期徒刑、拘役或者管制，并处罚金；情节严重的，处五年以上有期徒刑，并处罚金。 引诱不满十四周岁的幼女卖淫的，处五年以上有期徒刑，并处罚金。
第三百六十条 明知自己患有梅毒、淋病等严重性病卖淫、嫖娼的，处五年以下有期徒刑、拘役或者管制，并处罚金。
