法律分析：根据我国法律规定，16岁以下属于童工，17岁的不属于未成年工，不需要处罚。
法律依据：
《中华人民共和国劳动法》第十五条 禁止用人单位招用未满十六周岁的未成年人。 文艺、体育和特种工艺单位招用未满十六周岁的未成年人，必须遵守国家有关规定，并保障其接受义务教育的权利。
《中华人民共和国劳动法》第九十四条 用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款；情节严重的，由市场监督管理部门吊销营业执照。
