释义	下列救助行为无权获得救助款项：(一)正常履行拖航合同或者其他服务合同的义务进行救助的，但是提供不属于履行上述义务的特殊劳务除外;(二)不顾遇险的船舶的船长、船舶所有人或者其他财产所有人明确的和合理的拒绝，仍然进行救助的。救助方有过失，还能获得报酬吗由于救助方的过失致使救助作业成为必需或者更加困难的，或者救助方有欺诈或者其他不诚实行为的，应当取消或者减少向救助方支付的救助款项
