释义	法律分析：判断恶意调岗的办法：如果用人单位调整岗位对员工明显不利的，或者故意调离工作岗位的，没有与员工协商单方调整员工的工作岗位的，用人单位在短时间内频繁让员工调整工作岗位的，属于恶意调岗；用人单位恶意调岗的，劳动者可以拒绝，或可以向当地劳动保障部门投诉。法律依据：《中华人民共和国劳动合同法》第三十五条用人单位与劳动者协商一致，可以变更劳动合同约定的内容。变更劳动合同，应当采用书面形式。变更后的劳动合同文本由用人单位和劳动者各执一份。
