释义	法律分析：法院审理案件就是基于当事人提起的诉讼，当事人不主动到法院起诉立案，法院当然不会主动来审理案件。案件在审理中，法院只能按照当事人提出的诉讼事实和主张进行审理，对超过当事人诉讼主张的部分不得主动审理。法律依据：《中华人民共和国民事诉讼法》第十三条对当事人的处分权利规定为：当事人有权在法律规定的范围内处分自己的民事权利和诉讼权利。第一百零八条起诉条件为有合法的原告，明确的被告，具体的诉讼请求和事实、理由。
