关于医疗事故医生的处罚，发生医疗事故，医疗机构和医务人员应当承担法律责任，根据《医疗事故处理条例》第五十五条规定，发生医疗事故，除了医疗机构要承担医疗事故赔偿责任外，还应当承担以下法律责任：1、医疗机构发生医疗事故的，由卫生行政部门根据医疗事故等级和情节，给予警告；情节严重的，责令限期停业整顿直至由原发证部门吊销执业许可证。2、对发生医疗事故负有责任的医务人员依照刑法关于医疗事故罪的规定，依法追究刑事责任；尚不够刑事处罚的，依法给予行政处分或者纪律处分。3、对发生医疗事故的有关医务人员，卫生行政部门并可以责令暂停6个月以上1年以下执业活动；情节严重的，吊销其执业证书。（1）在目前社会体制下，对医疗机构和医务人员的行政处罚往往会收到令人意想不到的效果。但是正由于医疗事故行政处罚的存在，也往往导致医疗事故技术鉴定“手下留情”。（2）并非发生医疗事故就一定构成医疗事故罪。医疗事故罪是指医务人员由于严重不负责任，造成就诊人死亡或者严重损害就诊人身体健康的行为。医疗事故罪，处3年以下有期徒刑或者拘役。医疗事故罪的评价标准是“严重不负责任”，而非医疗事故本身。也就是说医疗事故罪只处罚“严重不负责任”造成的医疗事故行为；即使发生医疗事故，没有达到“严重不负责任”的程度，则不构成医疗事故罪。目前司法解释没有对何种行为属于“严重不负责任”作出规定，患者追究医疗事故罪基本不可能。
