释义	1、开设赌场中途退出不算犯罪中止。 2、根据《刑法》第二十四条规定，在犯罪过程中，自动放弃犯罪或者自动有效地防止犯罪结果发生的，是犯罪中止。对于中止犯，没有造成损害的，应当免除处罚；造成损害的，应当减轻处罚。在共同犯罪中，行为人退出后，并且能够阻止其他共同犯罪人继续实施犯罪或者有效地防止犯罪结果发生的，就可以认定为犯罪中止；行为人只是简单的退出，未防止犯罪结果发生的，不能认定为犯罪中止。法律依据《中华人民共和国刑法》第二十四条
