释义	法律分析：中级人民法院收到上诉状，应当在五日内将上诉状副本送达对方当事人，对方当事人在收到之日起十五日内提出答辩状。当事人直接向第二审人民法院上诉的，第二审人民法院应当在五日内将上诉状移交原审人民院。人民法院应当在收到答辩状之日起五日内将副本送达上诉人。对方当事人不提出答辩状的，不影响人民法院审理。法律依据：《中华人民共和国人民法院组织法》第二十五条基层人民法院审理第一审案件，法律另有规定的除外。基层人民法院对人民调解委员会的调解工作进行业务指导。
