法律分析：
一、申请人申请仲裁应当提交书面仲裁申请，并按照被申请人人数提交副本。仲裁申请书应当载明下列事项：
1、劳动者的姓名、性别、年龄、职业、工作单位、住所、通讯地址和联系电话，用人单位的名称、住所、通讯地址、联系电话和法定代表人或者主要负责人的姓名、职务;
2、仲裁请求和所根据的事实、理由;
3、证据和证据来源，证人姓名和住所。
二、书写仲裁申请确有困难的，可以口头申请，由仲裁委员会记入笔录，经申请人签名或者盖章确认。
三、申请人的书面仲裁申请材料齐备的，仲裁委员会应当出具收件回执。
四、对于仲裁申请书不规范或者材料不齐备的，仲裁委员会应当当场或者在五日内一并告知申请人需要补正的全部材料。申请人按要求补正全部材料的，仲裁委员会应当出具收件回执。

《中华人民共和国劳动争议调解仲裁法》 第五条 发生劳动争议，当事人不愿协商、协商不成或者达成和解协议后不履行的，可以向调解组织申请调解;不愿调解、调解不成或者达成调解协议后不履行的，可以向劳动争议仲裁委员会申请仲裁;对仲裁裁决不服的，除本法另有规定的外，可以向人民法院提起诉讼。
