释义	法律分析：强奸案件一般不会公开开庭审理。虽然被害人有权申请公开，但法院一般也不会批准。即便被害人不怕公开个人隐私，法院也会考虑到社会民情、道德风尚方面的影响，拒绝公开开庭审理。如果庭审有不公正的地方，可以提起上诉。法律依据：《中华人民共和国刑事诉讼法》第一百八十八条人民法院审判第一审案件应当公开进行。但是有关国家秘密或者个人隐私的案件，不公开审理；涉及商业秘密的案件，当事人申请不公开审理的，可以不公开审理。不公开审理的案件，应当当庭宣布不公开审理的理由。
