儿童犯罪年满几岁可以判刑？ |

法律分析：在我国未成年人在是指未满十八周岁的公民，对未成年人保护的法律有《未成年人保护法》和《预防未成年人犯罪法》等。
《最高人民法院关于办理未成年人刑事案件适用法律的若干问题的解释》第一条第一款：“未成年人犯罪，是指已满14岁不满18岁的人实施了法律规定的犯罪行为。刑事责任年龄一律按公历的年月日计算，并且应自行为人出生的年月日起按日为单位计算实际年龄。即“不满14周岁”“不满16周岁”“不满18周岁”应包括该周岁生日那天在内，从该生日的第二天起才为“已满”。
我国《刑法》第十七条规定：已满十六周岁的人犯罪，应当负刑事责任。
已满十四周岁不满十六周岁的人，犯故意杀人、故意伤害致人重伤或者死亡、强奸、抢劫、贩卖毒品、放火、爆炸、投放危险物质罪的，应当负刑事责任。
法律依据：《中华人民共和国刑法》 第十七条 已满十六周岁的人犯罪，应当负刑事责任。
已满十四周岁不满十六周岁的人，犯故意杀人、故意伤害致人重伤或者死亡、强奸、抢劫、贩卖毒品、放火、爆炸、投放危险物质罪的，应当负刑事责任。
已满十四周岁不满十八周岁的人犯罪，应当从轻或者减轻处罚。
因不满十六周岁不予刑事处罚的，责令他的家长或者监护人加以管教；在必要的时候，也可以由政府收容教养。
