给警察录音违法吗

释义

法律主观：

不违法，一般情况下是可以录音的。可以进行拍摄、录音。但是最好是经过公安人员的同意才可以。一般只要取得的方式是合法的就可以，如果是用窃听窃录或者对内容进行修改编辑则属于违法行为。

法律客观：

《最高人民法院关于民事诉讼证据的若干规定》第六十八条一方当事人提出的下列证据，对方当事人提出异议但没有足以反驳的相反证据的，人民法院应当确认其证明力：有其他证据佐证并以合法手段取得的、无疑点的视听资料或者与视听资料核对无误的复制件。
