释义	法律分析：当事人之间关于债务人届期不履行债务时，债权人（抵押权人）有权直接取得抵押财产所有权的约定称为“流押条款”。此条款是无效的，抵押权人只能依法就抵押财产优先受偿。法律依据：《中华人民共和国民法典》第四百零一条抵押权人在债务履行期限届满前，与抵押人约定债务人不履行到期债务时抵押财产归债权人所有的，只能依法就抵押财产优先受偿。第四百二十八条质权人在债务履行期限届满前，与出质人约定债务人不履行到期债务时质押财产归债权人所有的，只能依法就质押财产优先受偿。
