释义	法律分析：所谓怠于行使，是指应该行使并且能够行使权利却不行使。怠于行使的表现主要是在债权期限到来后根本不主张权利或迟延行使权利。如果债务人已经向第三人提出了请求，或者已经向法院提起诉讼，则不能认为其怠于行使权利。法律依据：《中华人民共和国民法典》第五百三十五条因债务人怠于行使其债权或者与该债权有关的从权利，影响债权人的到期债权实现的，债权人可以向人民法院请求以自己的名义代位行使债务人对相对人的权利，但是该权利专属于债务人自身的除外。
