什么叫反诉?怎么反诉?

释义

法律主观：

反诉是指对本诉提出的概念，在已经开始的诉讼程序中，本诉的被告通过法院向本诉的原告提出的一种独立的反请求。反诉的原告就是本诉的被告，被告提起反诉的目的，在于抵消或者吞并原告所提起之诉，使原告败诉。反诉必须与本诉为同一诉讼程序，而且被告提起的诉讼与原告提起的诉讼，是互为相反诉讼，联系密切。因此反诉可以原诉合并审理。

法律客观：

《民事诉讼法》第126条原告增加诉讼请求、被告提出反诉、第三人提出与本案有关的诉讼请求，可以合并审理。
