个人独资企业有法人吗?
释义
法律分析：个人独资企业，不是法人。个人独资企业是指依法在中国境内设立，由一个自然人投资，财产为投资人个人所有，投资人以其个人财产对企业债务承担无限连带责任的经营实体。个人独资企业是非法人企业，虽不具有法人资格，也无独立承担民事责任的能力。个人独资企业虽不具有法人资格，但却是独立的民事主体，可以自己的名义从事民事活动。
法律依据：《中华人民共和国公司法》第十三条公司法定代表人依照公司章程的规定，由董事长、执行董事或者经理担任，并依法登记。公司法定代表人变更，应当办理变更登记。
