释义	回扣立案标准为超过5000元即可立案。利用职务上的便利收受他人回扣的，数额达到较大的，则构成非国家工作人员受贿罪。索取或收受贿赂必须数额较大，才能够构成本罪。所谓数额较大，是指索取或收受5000元至20000元以上者。公司、企业的工作人员在经济往来中，违反国家规定，收受各种名义的回扣、手续费，归个人所有的，应以受贿行为论处。
