释义	从我国无效合同的规定中可以看出，借款合同无效的是不能返还利息的。合同一旦被确认无效，就产生溯及既往的效力，即自合同成立时起不具有法律的约束力，以后也不能转化为有效合同。所以说，借款合同无效过后，又不能转化为有效合同，借款人自然没有义务返还利息。【法律依据】《民法典》第一百五十五条无效的或者被撤销的民事法律行为自始没有法律约束力。
