释义	法律分析：在保证债务中，保证人虽对债权人不享有要求其对待给付的权利，但并不等于保证人仅承担义务而不享有任何权利，保证人对债权人仍然享有一些权利，只不过这些权利均属于消极的、防御性权利即抗辩权。法律依据：《中华人民共和国民法典》第六百八十七条第二款一般保证的保证人在主合同纠纷未经审判或者仲裁，并就债务人财产依法强制执行仍不能履行债务前，对债权人可以拒绝承担保证责任。
