释义	法律分析：有如下的特征：(1)行政行为是执行法律的行为，任何行政行为均须有法律根据，具有从属法律性；(2)行政主体在实施行政行为时具有单方意志性，不必与行政相对方协商或征得其同意，即可依法自主作出；(3)行政行为是以国家强制力保障实施的，带有强制性，行政相对方务必服从并配合行政行为。法律依据：《行政处罚法》第二十八条违法行为构成犯罪，人民法院判处拘役或者有期徒刑时，行政机关已经给予当事人行政拘留的，应当依法折抵相应刑期。
