释义	法律分析: 禁止过度原则：亦可称适度原则。即要求行政主体在限制个人利益的手段与实现公共利益的目的之间进行相衡，以选择一种即为现实公共利益所绝对必要，也为对相对人利益限制或损害最少的手段。法律依据: 《中华人民共和国行政处罚法》第五条行政处罚遵循公正、公开的原则。设定和实施行政处罚必须以事实为依据，与违法行为的事实、性质、情节以及社会危害程度相当。对违法行为给予行政处罚的规定必须公布；未经公布的，不得作为行政处罚的依据。
