一、先开发票后付款的行为法律允许吗
先开发票后付款的行为不被法律认可，存在大量风险。
尽管在生活实践中，存在大量的先开发票后付款的交易习惯，但是我国《发票管理办法实施细则》第3条明文规定，“发票，是指在购销商品，提供或者接受服务以及从事其他经营活动中，开具、收取的收付款凭证。”所以说先开发票后付款的行为不被法律认可，存在大量风险。
二、“先开发票后付款”的风险规避
“先开发票后付款”存在着极大的法律风险，若要规避这些风险，应当把握如下两点：
1、一般情况，尽量在得款后再开发票;
2、如若买方坚持要求先开发票后付款，可要求买方在接受发票的同时，以书面形式签下一份“先开发票，款未付或款日后再付”的单据，格式如下：
公司(卖方)：
今为便于我公司入账，收到贵公司送来发票张(发票号，金额人民币大写元)，以上金额我公司尚未支付贵公司，现承诺将于年月日全额支付，立此单据为证，以便贵公司记账。
公司(买方)年月日
这种单据在送发票时要求对方签字、盖章，若对方表示拒绝，应当断然拒绝对方“先出发票后付款”的要求，以防后患。
