释义	法律分析：合同纠纷没有反诉的，可以另行提起诉讼。在本诉阶段的法定期限内合同纠纷的当事人未向法院提出反诉的，被告可以在之后提起另案起诉，法院对此应当将其合并审理。因为此时该另行起诉的案件与本诉是基于同一事实的。法律依据：《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第二百三十三条反诉的当事人应当限于本诉的当事人的范围。反诉与本诉的诉讼请求基于相同法律关系、诉讼请求之间具有因果关系，或者反诉与本诉的诉讼请求基于相同事实的，人民法院应当合并审理。
