    1、当事人须为办理了结婚登记的合法夫妻；
    2、均具有完全民事行为能力；
    3、当事人双方必须具有离婚的共同意愿；
    4、双方已经达成离婚协议，并且离婚协议中关于财产分割，子女抚养问题已经达成共识。

法律客观：

《婚姻登记条例》第十二条办理离婚登记的当事人有下列情形之一的，婚姻登记机关不予受理： (一)未达成离婚协议的； (二)属于无民事行为能力人或者限制民事行为能力人的； (三)其结婚登记不是在中国内地办理的。
